Types of cases tried in the federal courts
District courts
These courts are formally know as the original jurisdiction courts.
They here both civil and criminal cases.
A civil case is
a legal case involving civil law or common law, which involves disputes between
individuals or organizations in which some form of compensation may be awarded
to the victim.
A criminal case is where the prosecuter is the one starting the trial. The defendents almost always have a jury trial unlike a civil case where they sometimes have a jury trial.
US court of appeals
In the court of appeals they only hear cases if any party is not satisfied on how it turned out they will reveiw to see if laws were not enforeced. They will not look for more evidence.
Supreme court
The supreme court is made up of 9 justices. They are located in Whashington D.C.
They will hear cases from partys that are not satisfied with how the court of appeals presided.
The supreme court only hears about 100 to 150 cases a year. There are around 7000 cases sent in a year.
To hear a case the judges will sit down and look at the facts if they believe it is a worthy case to hear they will accept it.
Famous cases in the supreme court
Brown v. The board of education
In 1952 some kids wanted to go to a white school but the education boards said no. Because the schools are segregated.So the supreme court came to the descision that you have to allow the kids to go to the school. Segregation is not equal.
Plessy v.Ferguson
In 1895 a the topic of having segragated rail cars was brought up. The supreme court decided that the ruling is that when it is seperate but equal it is fine.
Miranda v. Arizona
Someone was being questioned while in custody and was never read his rights. So the supreme court ruled that you have to read someone there rights before you start questioning them. But in the end they still ended up finding him guilty but without the evidence that they found before he was told his rights.
